Des Moines has it's 8th homicide of the year...but this one police say was a "lawful self defense" case.
It happened around 11:30pm Saturday night in the 200 block of E. Park Avenue. 32 year old Joshua Wheeler muscled his way into the home of a 25 year old ex-girlfriend, who was there with a 27 year old male friend.
Des Moines Police say that Wheeler was not legally allowed at the residence, since the woman had a restraining order against him.
Wheeler attacked the man, and during the fight, the other man shot Wheeler once in the abdomen.
Wheeler was taken to Iowa Methodist Medical Center where he later died.
Police say that the other man lawfully possessed the weapon.
The facts of the case where related to the Polk County Attorney's office and it was decided that no criminal charges would be filed at this time.
The names of the others in the case were not released.
