No charges will be filed against a Council Bluffs Police officer who shot a robbery suspect earlier this month.
The Pottawattamie County Attorney's Office says they found no wrongdoing when Officer Mike Roberts shot suspect Jimmy Carr at a gas station on May 2nd.
Around 8:00 that morning, Roberts arrived at the Bucky’s Gas station on Nebraska Avenue. As Roberts approached the entrance of the business, he was informed by a Bucky’s employee that a man, Jimmy Carr, had just stolen a gas can from the business. When Roberts confronted Carr he reached in his pocket, displayed a gun and fired. Roberts returned fire, hitting Carr.
The County Attorney's Office says that during an interview with police, "Carr was vague about what happened in the parking lot, indicating that it 'happened so fast' and that he sort of 'blacked out.' Carr indicated that he was carrying the gun for protection and that he was shot because he was 'paranoid' and 'reached for something.'"
On Monday, Carr was booked into the Pottawattamie County Jail. He had been at the Douglas County Jail, in Omaha, since May 4th, after being discharged from the Nebraska Medical Center. Carr is being charged with Attempted Murder of a Police Officer, Robbery 1st Degree and Felon in Possession of a Firearm.
Roberts, a 22-year veteran with the Council Bluffs Police Department, has been on administrative leave since the shooting.
