The Douglas County Sheriff's Office says they have conferred with the County Attorney and is sharing the following confirmed facts surrounding the deputy- involved shooting last weekend in Northwest Omaha.
In a news release from the Sheriff, investigators say at approximately 04:45 a.m. last Saturday, a domestic disturbance transpired in the intersection of 108th and Maple.
The disturbance was precipitated by occupants of a gold 4-door Cadillac sedan which had multiple occupants, one occupant was Daveyon Sherman.
Daveyon Sherman was a participant in the disturbance in the street.
The Cadillac was left parked in the street.
This incident is captured on video.
At 4:49 a.m., off-duty Deputy Kevin Clark, driving west on Maple Street in his personal vehicle, observed this disturbance and called 911 to request on-duty officers to respond.
Deputy Clark remained on the phone with 911 and continued westbound, past the disturbance, towards the DCSO Law Enforcement Center.
Deputy Clark then decided to conduct a U-turn on Maple Street in order to provide 911 dispatch with further updates. This is captured on 911 audio recording.
Deputy Clark was off-duty, in plain clothes and thus not wearing a Body Worn Camera. Nor was his personal vehicle equipped with a video recorder.
Upon returning back to the intersection of 108th and Maple Street, Deputy Clark, now eastbound, observed that the gold Cadillac sedan and disturbance had repositioned on 108th St., just south of Maple.
The gold Cadillac was again parked in the street. Deputy Clark updated 911 that he now observed an active fight between a male and female and advised 911 that he was going to intervene.
Deputy Clark advised 911, “They are fighting in the middle of the street so I am going to go ahead and stop them, go ahead and expedite me another car.” This is captured on 911 audio recording.
On a Facebook live video, streamed by an occupant of the gold Cadillac sedan, the escalation of the disturbance can be heard.
A female can be heard yelling, “Get off me! Stop (obscenity) pushing me!” The female appears to be crying in the audio and further stated, “You ripped my wig!
A male voice can then be heard saying, “Get back in the car then.”
An intense inaudible disturbance continues, presumably between the same male and female. This is captured on Facebook live audio.
Upon exiting his personal vehicle, Deputy Clark loudly announced that he is a “police officer” and gives a loud verbal command to "stop!”. This is captured on 911 audio recording.
At this point, there appears to be an escalating interaction between Deputy Clark and Mr. Sherman in the street.
This is the pivotal point that investigators continue to clarify and corroborate with evidence and witness statements.
It has been determined by investigators that Mr. Sherman was not armed with a physical weapon at the time of this escalating incident.
Within 10 seconds of Deputy Clark ordering “Stop!” a single gunshot shot is heard. This is captured on 911 audio recording.
Deputy Clark rendered first aid to Mr. Sherman by applying compression to the wound site.
Deputy Clark says, “I’m a police officer. Everyone back off so I can try to give him medical.” This is captured on 911 audio recording and further corroborated by physical evidence.
Omaha Police Department Uniformed Patrol Officers arrive on the scene at 4:54 a.m.
Upon the completion of the investigation and the final review by the Douglas County Attorney’s Office, DCSO intends to provide a comprehensive overview of the facts and findings to the public to include video, audio, and witness interview evidence.
