(Davenport, IA) -- A lawsuit over an Iowa school district recount has been dismissed.
A Scott County judge says Tracey Rivera, an incumbent who lost the Pleasant Valley School District 6 race by six votes, should have officially contested the election results when the Scott County Board of Supervisors ignored a recount that showed the race was a tie.
The Quad City Times reports that the Iowa Secretary of State's office later said the recount included invalid write-in ballots.
Jameson Smith was declared the winner of the election and seated on the Pleasant Valley School Board in late November.
