(Davenport, IA) -- Three defendants who asked the Iowa Supreme Court to remove them from a lawsuit filed by tenants of the Davenport apartment building that partially collapsed last year will remain as defendants.

The Quad City Times reports that a judge told the city of Davenport, it's chief building inspector, and neighborhood services director, that under Iowa law they were potentially liable, for the inspections they performed on the building.

The judge did agree that former Davenport city administrator Corri Spiegel be released from the lawsuit.

Three men died when 324 Main Street partially collapsed May 28th of last year.
