(Knoxville, Iowa)  A Marion County man's been charged with First Degree murder, in the 2015 death of his mother.

Forty-five-year-old Jason Carter was arrested Sunday afternoon without incident, and taken to the Marion County Jail.  Bond has been set at $1 million.

Carter was to make his initial court appearance this (Monday) morning.

A jury in a wrongful death lawsuit found Jason Carter last week liable for killing Shirley Carter.   His father, Bill Carter filed the lawsuit.

The Marion County Sheriff's Office released a statement regarding the timing of the charge:

"The burden in a civil case is by a preponderance of the evidence, whereas, a criminal is beyond a reasonable doubt.  Moreover, a decision was made by the investigating team after a comprehensive investigation which included a review of the evidence and testimony that was offered at the time of the civil trial as well as the thousands of hours of of investigation since Mrs. Carter's death that the arrest of Jason Carter was appropriate at this time."
