ABC has accused the administration of President Donald Trump of violating its free speech rights in response to a federal investigation into whether the talk show The View broke the Federal Communications Commission's (FCC) equal time rule for political candidates. The dispute centers on recent appearances by Texas Senate candidate James Talarico and his Democratic rival Jasmine Crockett on the show.

The FCC, led by Chairman Brendan Carr, a Trump appointee, confirmed it has launched an enforcement action against ABC and is reviewing whether The View must provide equal airtime to all candidates running for the same office, as mandated by law.

ABC, owned by Disney, responded in a filing to the FCC, arguing that the investigation creates a "chilling effect" on First Amendment freedoms and threatens press independence. The network claims that the regulatory action is motivated by partisan interests and undermines the traditional news exemption for talk shows. The FCC has recently issued guidance warning that programs like The View and late-night talk shows should not assume they are exempt from the equal time rule unless they consult directly with the agency.

The controversy intensified after Talarico appeared on The View and on The Late Show with Stephen Colbert. CBS decided not to air Colbert’s interview with Talarico, citing legal guidance about potential equal time violations. The interview was later posted on YouTube, outside FCC authority, and Talarico reportedly raised $2.5 million in campaign donations following the broadcast as reported by Deadline.

FCC officials say the equal opportunity requirement applies to all legally filed candidates, regardless of party, and that networks could meet the rule by offering airtime or running candidate ads. The FCC has questioned whether talk shows like The View qualify for the "bona fide" news exemption, noting that no evidence has been submitted to support such claims.
