Iowa law banning mask order in schools back in federal court

(Omaha, NE) -- The State of Iowa is in federal court in Omaha today, hoping to reinstate a state law banning face mask requirements in schools.

The challenge to Iowa's law is brought by ARC, an organization that on its website says it actively supports full inclusion in the community for people with intellectual and physical disabilities. ARC is joined in the civil suit by a list of parents with disabled children, claiming the Iowa law is a violation of the Americans with Disabilities Act. The parents say banning mask mandates in schools endangers their children's lives, or forces them to keep the kids out of school.

A federal judge earlier agreed with the parents, and put a restraining order on the Iowa law, allowing schools in Iowa to require face masks.

Governor Reynolds is appealing the restraining order in the 8th District U.S. Circuit Court of Appeals. The case is being heard by a panel of three judges at the Federal Court in Omaha today.
