Former Polk County sheriff's deputy, Sgt. Dan Charleston's lost the appeal of his firing.
A Polk County District Court judge ruled that the former sergeant failed to show the Polk County Civil Service Commission erred in affirming Charleston's firing by Sheriff Bill McCarthy.
Charleston's lawyers argued he was fired without just cause and was targeted for termination because he ran twice against McCarthy for sheriff and lost.
However, Assistant Polk County Attorney Ralph Marasco, Jr. argued that the commission ruled that Charleston was insubordinate and didn't follow orders.
