Court may decide Iowa House race

Winneshiek County, Iowa - The Iowa House race for District 55 in northeastern Iowa may be decided in court. 

A judge is ordering the Winneshiek County Auditor to look at postmark bar codes to determine if 33 uncounted ballots were put in the mail in time to be counted. The ballots were delivered after the deadline.  

But, today, the Iowa Secretary of State's office certified Republican candidate Michael Bergan as the winner, by a 9 vote margin over Democratic candidate, Kayla Koether. She says bar codes on the envelopes should count, but the Secretary of State's office says Winneshiek County doesn't use the bar codes that are part of Iowa election law.  

The question will be, which interpretation of the election law the judge will go with.
