(Omaha, NE) -- Nebraska Congressman Fortenberry's legal team is back in court, and asking the judge to strike an interview from evidence.
The team says investigators misled Fortenberry during an interview in March of 2019 while in Lincoln.
During the interview, Fortenberry was made to believe the interview was regarding another witness, and later agreed to a second interview.
According to his legal team, he may not have agreed to the second interview if Fortenberry knew he was the subject of the investigation.
The judge is yet to rule on the motion. The federal trial is set for Tuesday, February 15th.
