(Bettendorf, IA) -- A new lawsuit's been filed against the designer of the I-74 Pedestrian Bridge and the City of Bettendorf.

The suit claims they intentionally disregarded the direction of the Iowa Department of Transportation and opened the pedestrian walkway at a time when the walkway was not complete and safe for pedestrian use.

Three men were walking on the 14-foot wide I-74 pedestrian path at two a.m. on May 22, 2022 when a car drove onto the path, hitting the men, killing two of them.

WQAD-TV 8 reports the survivor, Charles Bowen is suing Bettendorf and WHKS & Co. Inc for damages in excess of $75,000.

After the crash the Iowa Department of Transportation put barriers and signs on the path.

The driver in the crash, 46-year-old Chianti’s Harris of East Moline is facing charges in the case.
