(Dubuque, IA) -- A former priest in Dubuque, Iowa accused of abusing alter boys in the 1980s will appear in court today.

A judge will decide on a request to dismiss five counts of second degree sexual abuse against Leo Riley.

Lawyers for Riley filed the motion last week, saying too much time has passed.

Prosecutors says the statute of limitations was put on hold when Riley moved to Florida before it expired.
