(Orion, IL) -- Nearly two months after April's election, the mayor Orion residents chose still hasn't been sworn in.

Aaron Peer won the support of 76% of voters, but Illinois law prevents him from taking office.

Peer's attempt to get a decades old felony conviction expunged from his record at a hearing on Friday failed due to incomplete paperwork and a missing drug test.

The village board appointed Mayor Pro Tem Steve Newman to the position while awaiting Peer's hearing.

Newman is agreeing to step aside if Peer can get his conviction erased by next Monday. Otherwise, he says the village needs to move forward.
