(Louisa County, IA) -- A lawyer for the man accused of dragging another man behind his van after shooting him in the face, wants the case against his client dropped.

Fifty-eight year-old Salvador Castaneda is accused of fatally shooting Noe Tejirina and dragging him by the neck near Columbus Junction in late June.

His lawyer is filing a motion to suspend the case saying Castenada can't follow conversations, and doesn't understand the charges against him due to an unspecified mental disorder.

Castenada remains in jail on a million-dollar bond and an ICE detainer.
