(McCook, NE) -- A judge Monday issues a ruling in a lawsuit to stop the planned use of a Nebraska Corrections facility by Homeland Security and ICE for the detention of illegal detainees.
Red Willow County District Judge Patrick Heng rules the case will continue and not be dismissed, but the re-purposing of the Work Ethic Camp in McCook will also continue as the case is adjudicated.
The plaintiffs' motion for a temporary restraining order and the state's motion for dismissal are both denied.
Thirteen McCook residents and a former State Senator filed the lawsuit arguing the Governor does not have the authority to transform the state's Work Ethic Camp into the "Cornhusker Clink" without approval from the Legislature
The State argues the case should be dismissed, saying the plaintiffs do not have standing and the court has no jurisdiction.
