A former superintendent of schools in Des Moines is resisting an effort by the school district and two of its employees to have a Polk County Judge hear an appeal of a decision last month allowing a lawsuit against them to go forward.

Dr. Nancy Sebring sued the district, and employees Phil Roeder and Patricia Lantz for invasion of privacy.

She claims they should not have released private emails sent from her district computer that reveal an affair she was having.

Judge Glenn Pille last month denied the district's attempt to have the lawsuit dismissed.

Sebring attorney Thomas Foley argues against the request for an interlocutory appeal  

saying the case needs to go forward so all of the facts can come out.
